Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of OASIS (Organizational Awareness & Safety Information Systems), operated by LD Safety Solutions, Inc. ("Company", "we", "us", or "our"). By accessing or using OASIS, you agree to these Terms.

1. Service Status

OASIS is an active release and remains a work in progress. The platform may contain bugs, errors, or incomplete features.

Functionality may change as the service improves, and we may add, change, or remove features with notice where required by law.

2. Use of Service

You agree to use OASIS only for lawful business purposes and in accordance with these Terms.

3. Definitions

"Account Owner" means the person, company, employer, organization, or other entity that creates, purchases, manages, controls, or administers an account or subscription for the Service.

"Users" means all individuals who access or use the Service, including account owners, administrators, supervisors, employees, contractors, seasonal workers, invited members, and other authorized users.

"LD Safety Solutions," "we," "us," and "our" refer to LD Safety Solutions, the provider of the Service.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.

5. Subscriptions & Payments

Some features may require a paid subscription. Payments are processed through secure third-party providers. LD Safety Solutions, Inc. does not store full payment card details.

6. Customer Data Ownership

You retain full ownership of all data uploaded to OASIS.

You grant LD Safety Solutions, Inc. a limited license to store, process, and display your data solely for the purpose of providing the service.

7. Workplace Safety, Compliance, Records, and User Responsibilities

The following terms apply specifically to workplace safety, compliance, records, training, incident reporting, and account administration within the Service.

8. Account Owner and User Responsibility for Workplace Safety

The Service is intended to assist Account Owners and Users with organizing, documenting, communicating, and tracking workplace safety-related activities. The Service is a support tool only. Account Owners remain solely responsible for establishing, implementing, maintaining, supervising, and enforcing their workplace safety programs, policies, procedures, trainings, inspections, hazard assessments, incident response procedures, corrective actions, and compliance obligations.

Account Owners are responsible for determining which federal, state, local, industry-specific, agricultural, labor, insurance, audit, certification, or other requirements apply to their business, worksites, employees, contractors, seasonal workers, visitors, equipment, chemicals, commodities, housing, transportation, and operations.

Use of the Service does not transfer any workplace safety, employment, supervisory, inspection, training, reporting, recordkeeping, or compliance obligation from the Account Owner or Users to LD Safety Solutions. Account Owners remain solely responsible for the acts, omissions, decisions, supervision, training, and working conditions of their owners, managers, supervisors, employees, contractors, members, agents, and other personnel.

Account Owners and Users agree that LD Safety Solutions does not control any workplace, worksite, equipment, personnel, safety practice, hazard condition, training quality, incident response, corrective action, or compliance decision.

9. No Legal, Safety, or Compliance Advice

The Service does not provide legal, regulatory, safety engineering, human resources, insurance, medical, emergency, or compliance advice. Any templates, checklists, workflows, reports, alerts, reminders, trainings, forms, logs, communications, or other materials provided through the Service are for general informational and organizational purposes only.

Account Owners and Users should consult qualified legal counsel, safety professionals, compliance advisors, insurance representatives, medical professionals, or other appropriate professionals regarding their specific obligations and circumstances.

10. No Compliance Guarantee

LD Safety Solutions does not warrant, represent, or guarantee that use of the Service, or any document, checklist, training record, inspection record, hazard report, incident report, corrective action, acknowledgement, notification, reminder, dashboard, export, or other material created, stored, sent, or generated through the Service, satisfies any OSHA, state-plan OSHA, agricultural safety, labor, employment, wage and hour, workers' compensation, insurance, audit, certification, contractual, or other legal or regulatory requirement.

Account Owners and Users acknowledge that laws, regulations, standards, agency guidance, enforcement practices, and industry requirements may vary by jurisdiction and may change over time. Account Owners are solely responsible for reviewing and verifying the accuracy, completeness, timeliness, and legal sufficiency of all materials, records, procedures, and actions associated with their use of the Service.

LD Safety Solutions does not guarantee that use of the Service will prevent workplace injuries, illnesses, fatalities, hazards, violations, citations, penalties, fines, claims, lawsuits, insurance disputes, audit findings, or other adverse outcomes.

11. Training Materials and Completion Records

The Service may allow Account Owners and Users to assign, deliver, track, store, or document safety-related trainings, toolbox talks, policies, instructions, quizzes, acknowledgements, signatures, or other materials.

Account Owners are solely responsible for ensuring that all training materials are accurate, complete, current, appropriate for the applicable worksite and job duties, and compliant with applicable laws, regulations, standards, and internal policies.

Account Owners are solely responsible for ensuring that training is provided in a manner, language, vocabulary, format, and setting that is understandable and appropriate for the intended workers.

12. Acknowledgements and Signatures

Any completion status, electronic signature, checkbox, acknowledgement, timestamp, quiz result, or other in-app confirmation only reflects that a User completed an action within the Service. It does not guarantee that the User read, understood, retained, accepted, or is qualified to apply the information provided.

Account Owners remain solely responsible for confirming worker understanding, competency, authorization, supervision, and safe work performance. Account Owners are also responsible for determining whether additional in-person instruction, hands-on training, observation, language support, retraining, certification, documentation, or supervisor review is required.

LD Safety Solutions does not certify, license, qualify, approve, authorize, or deem any User competent to perform any task, operate any equipment, handle any chemical, supervise any worker, respond to any emergency, or perform any safety-sensitive activity.

13. Incident, Hazard, and Near-Miss Reporting

The Service may allow Account Owners and Users to report, document, track, or communicate regarding workplace incidents, injuries, illnesses, hazards, near misses, unsafe conditions, inspections, investigations, or corrective actions.

Account Owners are solely responsible for reviewing, investigating, responding to, correcting, escalating, and documenting all such reports in a timely and appropriate manner.

The Service is not a substitute for workplace supervision, emergency response, medical care, hazard correction, regulatory reporting, insurance reporting, workers' compensation reporting, or any other required action.

Account Owners are solely responsible for determining whether an incident, injury, illness, hazard, near miss, unsafe condition, or other event must be reported to OSHA, a state agency, emergency responders, insurers, workers' compensation carriers, law enforcement, employees, contractors, unions, customers, auditors, or any other person or entity.

14. Not an Emergency Service

The Service is not an emergency response system, emergency communication system, 911 service, medical service, or real-time hazard monitoring service.

Users should call emergency services, seek medical attention, notify appropriate supervisors, and follow the Account Owner's workplace emergency procedures in any urgent, dangerous, life-threatening, or potentially serious situation.

LD Safety Solutions is not responsible for monitoring reports submitted through the Service, determining whether an emergency exists, dispatching assistance, notifying authorities, correcting hazards, or ensuring that Account Owners or Users respond to reports.

15. Reporting Does Not Determine Legal Status

Any incident, injury, illness, hazard, near miss, or other event entered into the Service does not determine whether the event is legally recordable, reportable, compensable, work-related, covered by insurance, subject to investigation, or otherwise legally significant.

Account Owners are solely responsible for making those determinations based on applicable law and professional guidance.

16. Accuracy and Completeness of User Data

Account Owners and Users are solely responsible for the accuracy, completeness, timeliness, legality, and appropriateness of all information entered, uploaded, stored, transmitted, generated, or maintained through the Service.

This includes, without limitation, member information, employee information, contractor information, training records, acknowledgements, signatures, inspection records, hazard reports, incident reports, injury and illness information, corrective actions, worksite details, equipment information, chemical information, notes, photographs, documents, and communications.

LD Safety Solutions is not responsible for inaccurate, incomplete, outdated, misleading, false, delayed, duplicated, missing, or improperly entered information.

Account Owners are solely responsible for reviewing and verifying the information in their account before relying on it for safety, operational, legal, regulatory, insurance, audit, disciplinary, employment, or other purposes.

17. User Access and Account Controls

Account Owners are responsible for assigning appropriate User roles, permissions, and access levels; maintaining the confidentiality of login credentials; removing access for individuals who no longer require access; and ensuring that only authorized Users access sensitive workplace, employee, safety, or incident information.

Account Owners are responsible for all activity that occurs under their account, including activity by owners, administrators, supervisors, employees, contractors, seasonal workers, invited Users, and other members.

Users are responsible for maintaining the confidentiality of their own login credentials and for using the Service only as authorized by the Account Owner and these Terms.

18. Sensitive Information

Account Owners represent and warrant that they have all rights, notices, permissions, authorizations, consents, and legal bases necessary to submit, collect, use, disclose, and store any personal information, employment information, health-related information, injury or illness information, photographs, signatures, or other sensitive information through the Service.

Account Owners and Users agree not to submit sensitive information unless it is appropriate, lawful, and necessary for legitimate workplace safety, operational, recordkeeping, or compliance purposes.

19. Recordkeeping and Retention Responsibility

The Service may allow Account Owners and Users to create, upload, store, organize, export, or maintain safety-related records.

Account Owners are solely responsible for determining what records they are legally or contractually required to create, maintain, post, submit, preserve, or make available, and for determining the required format, contents, retention period, access rights, and submission method for those records.

Account Owners are solely responsible for maintaining independent copies of any records required by law, regulation, insurance policy, audit program, certification program, contract, or internal policy.

Account Owners should not rely on the Service as their sole repository for legally required, business-critical, or safety-critical records.

20. Data Export and Account Cancellation

Account Owners are responsible for exporting or downloading any records they wish to retain before canceling their subscription or before access to the Service is suspended or terminated.

After cancellation, expiration, suspension, or termination of an account, Account Owners and Users may lose access to records stored in the Service.

Unless otherwise stated in a separate written agreement or required by law, LD Safety Solutions may delete or make unavailable account data after account cancellation, expiration, suspension, or termination in accordance with its data retention practices.

21. Optional Customer-Friendly Export Period

Following cancellation or termination, Account Owners may request export of available account records for up to thirty (30) days, unless the account was terminated for unlawful conduct, misuse of the Service, security risk, nonpayment, or other cause that prevents or limits access.

After that period, LD Safety Solutions may delete or make unavailable account data in accordance with its data retention practices.

22. Data Risks

You are responsible for maintaining backup copies of any critical data.

  • Data loss or corruption may occur
  • Features may not function as expected

23. Data Security

We implement reasonable administrative, technical, and physical safeguards and utilize trusted infrastructure providers (including Supabase and Vercel). However, no system can guarantee absolute security.

24. Service Availability

We do not guarantee uninterrupted uptime, availability, or reliability.

25. Limitation of Liability

To the fullest extent permitted by law, LD Safety Solutions, Inc. shall not be liable for:

  • Loss of data
  • Security incidents beyond our reasonable control
  • Downtime or service interruptions
  • Any indirect, incidental, or consequential damages

26. Acceptable Use

You agree not to:

  • Attempt unauthorized access to systems or data
  • Interfere with platform performance
  • Use the service for illegal or harmful purposes

27. Termination

We may suspend or terminate access to the service at any time, with or without notice, subject to applicable law.

28. Changes to Service

We may modify or discontinue any part of the service at any time without liability.

29. Changes to Terms

We may update these Terms periodically. Continued use of the service constitutes acceptance of updated Terms.
